What Is Accelerated Approval? The Reversible FDA Shortcut

You own a biotech stock that got FDA accelerated approval. The stock jumped 40% on the headline. Six months later, the confirmatory trial fails and the FDA moves to withdraw the approval. The stock drops 60%. You didn’t know accelerated approval was conditional.
Accelerated approval is the FDA’s fastest path to market, but it’s built on a surrogate endpoint that hasn’t yet proven real clinical benefit, and the approval can be reversed if the confirmatory trial doesn’t verify that benefit.
What accelerated approval actually is
The FDA created the Accelerated Approval Program in 1992 during the AIDS crisis. Patients were dying while the agency took 10+ months to review applications. The program let the FDA approve drugs for serious conditions with unmet medical need based on a surrogate endpoint: a biomarker or intermediate measure reasonably likely to predict clinical benefit, but not itself the clinical benefit.
The rule lives at 21 CFR 314 Subpart H for NDAs and Subpart E for BLAs. Tumor shrinkage, dystrophin production, hemoglobin levels, proteinuria reduction: these are surrogates. They measure something biological that should correlate with patients feeling better or living longer, but the correlation isn’t confirmed until the confirmatory trial reads out.

The critical distinction investors miss
Traditional approval is based on demonstrated clinical benefit: patients lived longer, had fewer heart attacks, walked farther. It’s full and irreversible (absent a safety withdrawal).
Accelerated approval is based on a surrogate. It’s conditional. The company must run a confirmatory trial to verify that the surrogate actually predicts clinical benefit. If that trial fails, or doesn’t get completed, the FDA can withdraw the approval.
This is the single most misunderstood thing in biotech investing. The market often prices an accelerated approval as if it were permanent. It isn’t.
How often accelerated approvals get reversed
Roughly 15% of oncology accelerated approvals have been withdrawn since the program began, according to a 2024 analysis by Mehta et al. in the Journal of Clinical Oncology. A separate 2022 review found that over one-third of drugs granted accelerated approval had incomplete or delayed confirmatory trials. The FDA has been getting more aggressive about enforcement.
In 2022, Congress passed FDORA (Food and Drug Omnibus Reform Act), which gave the FDA expedited withdrawal authority. The agency no longer has to negotiate for years with a sponsor that won’t run the confirmatory trial. It can move faster, and it has.
Step 1: Check the confirmatory trial status
Go to ClinicalTrials.gov and search the drug name. Find the confirmatory trial. It’s usually a Phase 3 listed as a “post-marketing commitment” or “confirmatory.” Three things to check:
- Is it enrolled? A trial still recruiting two years after approval is a red flag.
- When is the readout expected? The estimated primary completion date tells you when the risk window opens.
- Has the FDA scheduled an AdCom to discuss withdrawal? Check the FDA advisory committee calendar. A withdrawal AdCom is the loudest possible warning.
Step 2: Evaluate the surrogate endpoint
Not all surrogates are equal. The FDA sorts them into tiers:
- Validated surrogates (e.g., blood pressure for cardiovascular drugs) are known to predict clinical benefit. Low reversal risk.
- Reasonably likely surrogates (e.g., dystrophin for DMD, objective response rate for some cancers) are thought to predict benefit but not proven. Higher reversal risk.
If the drug was approved on a novel, unvalidated surrogate, the confirmatory trial matters more. Sarepta’s Elevidys for Duchenne muscular dystrophy was approved on accelerated approval based on dystrophin production. Questions about whether that surrogate translates to functional benefit nearly derailed the program. The FDA has since tightened its stance on DMD surrogate endpoints.
Step 3: Read the postmarket commitments
When the FDA grants accelerated approval, it issues postmarket commitments: the specific requirements the company must meet to verify benefit. These are published in the approval letter and summary review on FDA.gov. Read them. They tell you exactly what trial, what endpoint, and what timeline the company committed to.
If the company is behind on those commitments, the approval is at risk. If the company is asking to change the endpoint or timeline mid-stream, that’s a yellow flag.
Step 4: Watch for accelerated-to-traditional conversion
Not all accelerated approvals stay accelerated. When the confirmatory trial succeeds, the company converts to traditional approval. This is the best-case scenario. The drug is now permanently approved, and the stock often re-rates.

Step 5: Price in the reversal risk
A drug on accelerated approval is worth less than a drug on traditional approval. If you’re holding a stock where the entire thesis rests on an accelerated approval and the confirmatory trial hasn’t read out, you’re carrying reversal risk every day. Size accordingly. Real examples from 2026
- Moderna (MRNA) mRNA-1010 flu vaccine is seeking accelerated approval for adults 65+ (PDUFA August 5, 2026). The AdCom voted 9-0 in favor on June 18. These are all real, current examples where the accelerated approval is either pending or recently granted. Each one carries reversal risk until the confirmatory trial reads out.
Common mistakes
- Treating accelerated approval as permanent. It isn’t. Roughly 15% of oncology accelerated approvals have been withdrawn. If your thesis doesn’t account for reversal risk, the thesis is incomplete.
- Ignoring the confirmatory trial timeline. The confirmatory trial readout is the second binary event. Mark it on the calendar alongside the PDUFA date.
- Buying after the accelerated approval pop without checking the surrogate. A novel surrogate means higher risk. A validated surrogate means lower risk. Know which one you’re buying.
- Assuming a withdrawal means the company is done. Some companies refile or negotiate a narrower label. But the stock still drops hard on the withdrawal announcement. Our CRL guide covers how binary rejections move stocks.
- Not reading the postmarket commitments. The approval letter tells you exactly what the company promised. If they’re behind, the risk is yours.
Final checklist
- Confirm the approval type: accelerated or traditional
- Find the surrogate endpoint and assess whether it’s validated or novel
- Check ClinicalTrials.gov for the confirmatory trial status, enrollment, or readout date
- Read the postmarket commitments in the FDA approval letter
- Check the FDA advisory committee calendar for any withdrawal discussions
- Size the position for reversal risk until the confirmatory trial reads out
